ABOUT COLLABORATIVE PRACTICE

Collaborative Practice is about cooperation, not confrontation. It is problem solving with collaborative lawyers, financial and family professionals who help you and your spouse achieve mutually satisfactory agreements finalizing your separation or divorce.

Why Collaborative Practice?

Is an interdisciplinary settlement focused team process which means that in addition to the two lawyers, the team includes one or more of the following: neutral family professional, such as registered psychotherapist/social worker, a neutral financial professional, such as chartered financial divorce specialist or financial mediator, and a chartered business valuator, if necessary.

The voluntary settlement process focuses on respectful communication, transparency and open communication to get to the heart of each separation partner’s interests, goals and concerns.

The Collaborative process does not avoid financial disclosure, nor does it avoid legal responsibilities.

BENEFITS OF USING THE COLLABORATIVE SETTLEMENT PROCESS

Rather than being bound by a Court schedule of conferences and hearings, the Collaborative Practice process uses informal meetings and discussion to settle all issues in a timely manner.

A holistic approach to resolving legal matters outside of court.

Keeps everything out of the court adversarial process.

Decreases the time coming to agreement. Time-efficiency saves money compared to other separation and divorce process options.

A compassionate, respectful approach sensitive to the emotional needs of the family in transition.

Progresses at a pace suitable for each separating partner.

Focuses on the wellbeing of the family in two homes, including children and pets.

Streamlines the process to include each professional to focus on their specific area of expertise.

Allows the separating couple to be the decision maker.

A process for separation, divorce, prenuptial and postnuptial agreements, parenting plans.

Collaborative family law offers several benefits, particularly for families going through a divorce or other legal matters. Here are some key advantages:

Less Adversarial Process: Collaborative family law emphasizes cooperation and mutual respect rather than confrontation. This approach reduces hostility and creates a more amicable environment for resolving disputes.

Control Over Outcomes: Both parties have more control over the process and outcomes. Instead of having a judge make decisions, the parties work together with their lawyers to reach agreements that suit their unique needs.

Cost-Effective: Because the process is typically faster and involves fewer court appearances, it can be less expensive than traditional litigation. By focusing on negotiation and settlement, legal fees and other costs are often lower.

Privacy: Collaborative family law proceedings are private, unlike court cases which are public records. This allows the parties to keep their personal matters confidential.

Focus on Children’s Well-being: The collaborative process often prioritizes the needs of children. By reducing conflict and focusing on cooperation, it creates a healthier environment for children, helping to preserve co-parenting relationships.

Customized Solutions: The collaborative approach allows for creative, customized solutions that might not be possible in a court setting. This flexibility can lead to more satisfactory outcomes for both parties.

Support from Professionals: In collaborative family law, other professionals such as financial experts, child specialists, or therapists can be brought in to assist with various aspects of the process. This team-based approach ensures that all relevant issues are thoroughly addressed.

Better Communication: The process encourages open and honest communication between the parties, which can lead to better understanding and more sustainable agreements.

Preservation of Relationships: By fostering a respectful and cooperative process, collaborative family law can help preserve relationships, which is particularly important when the parties need to continue to interact, such as in co-parenting situations.

Reduced Emotional Stress: The less combative nature of collaborative family law can help reduce the emotional stress often associated with divorce or family disputes, making the process less traumatic for everyone involved.

COLLABORATIVE PRACTICE IS NOT…..

A process to avoid financial disclosure.

A way to avoid legal responsibilities.

A process that allows the parties to hide behind their lawyers.

A process for lawyers to advocate using positional bargaining tactics (threats, delays, and ultimatums).

It is a process that gives equal importance to the emotional, financial and legal elements of separation and divorce.
